MUHAMMED LAWAL SHUAIBU, JCA (DELIVERING THE LEADING JUDGMENT): This appeal is against the judgment of the High Court of Cross-River State, sitting at Calabar, Coram Honourable Edem Ita Kooffreh, delivered on 10th October, 2018 wherein the respondents were discharged and acquitted of the offence of armed robbery.
A summary of the facts leading to this appeal as could be gleaned from the record of appeal show that on 29/4/2011 at about 9:45 pm at No. 37B Nkorib Layout, Ikot Ansa, behind INEC office; Calabar, the respondents and other allegedly robbed one Ifeoma Ugochukwu of a Hyundai Sotana car, cash amounting to N335,000.00, clipper and number of GSM handsets while armed with offensive weapons.
