J U D G M E N T 

Plaintiff’s case 

By an amended writ of summons issued on 21st August 2020, the plaintiff claimed the  following reliefs against the defendants: 

i. A declaration of title to the land in dispute. 

ii. Recovery of possession. 

iii. An order of perpetual injunction restraining the 1st and 2nd defendants  including their assigns, agents, servants and all persons claiming through  or under them from doing anything to disturb plaintiff’s ownership,  possession and user of the land in dispute. 

iv. General damages for trespass. 

v. Special damages. 

vi. Cost. 

The land in dispute was described in paragraph 17 of the amended statement of claim  as follows:

“All that piece or parcel of land situate, lying and being at McCarthy Hill,  Accra and containing an approximate area of 0.37 acre or 0.15 hectare more  or less and bounded on the north-west by assignor’s land measuring 140.0 feet  more or less, on the north-east by assignor’s land measuring 120.0 feet more  or less, on the south…
