ELFRIEDA OLUWAYEMISI WILLIAMS-DAWODU, J.C.A. (Delivering the Leading Judgment): This appeal emanated from the Judgment of the High Court of the Federal Capital Territory, Abuja delivered on March 11th, 2020 by Hon. Justice U. P. Kekemeke in Suit No. CR/287/17 between COP v. MOHAMMED TIJANI, wherein the Appellant (the Defendant at the Court below), was convicted and sentenced to death by hanging. 

The one count charge of culpable homicide punishable with death brought against the Appellant was as follows: 

ONE COUNT 

"That you Mohammed Tijani 'M' 18 years of Agwan Hausawa, Karu village FCT on the 12th of June, 2017 at about 2000 hrs within the jurisdiction of this Honourable Court committed an offence to wit: Culpable Homicide. You stabbed one Samsudeen Abdullai with a knife that led to his death and you knew that death is probable consequence of your action. You thereby committed an offence punishable under Section 221 of Penal Code Law."
