The Plaintiff/appellant (hereinafter referred to as the Plaintiff) a non-governmental organization sued the Defendant who is the Kyidomhene of Essuowin in the Circuit Court, Kumasi claiming:

a. For a declaration of title to and recovery of possession to plots numbers 1A and 8A Block B Santasi, Kumasi.

b. An order for perpetual injunction restraining the Defendant, his servants agents, workmen, labourers etc from entering upon the said land in dispute or in anyway interfering with the Plaintiffs lawful ownership and possession of the land.

c. Damages.”

The case of the Plaintiff is that it acquired two plots of land which is the subject matter in dispute from the late Chief of Essuowin, Nana Akyina Kesse IV in 1997 at the cost of ¢12million. According to the Plaintiff Nana Akyina Kesse IV issue the Plaintiff an allocation note and site plan in respect of the two plots.
