FASANMI JCA (Delivering the Lead Judgment: This is an appeal by the appellants/cross-respondents against the decision of the Rivers State High Court of Justice in suit No. PHC/1897/2004, delivered on 31 July 2009.

By paragraph 27 of the amended statement of claim at page 44 of the record of appeal, the respondent claims against the appellants thus:

“Whereof the plaintiff claims from the defendants jointly and severally the sum of ₦57,141,930,84 being special and general damages, as a result of the injuries the plaintiff sustained on 27 April 2002 which injuries were caused by the negligence and/or breach of the duty, and/or breach of the plaintiff’s contract of employment on the part of the defendants, their servants or agents.”
