(Delivering the Leading Judgment): This is an appeal against the judgment of the Kano State High Court of Justice (hereinafter referred to as the Lower Court) in Suit No. K/386/2007, delivered on the 3rd of March, 2015. At the Lower Court, the appellants as plaintiffs claimed declaratory reliefs and other orders against the respondents as the defendants in respect of a dispute arising from banking facilities granted to the appellant by the 1s respondent. Pleadings were filed, that is, the appellants filed their statement of claim, the respondents filed statement of defence and counter-claimed against the appellants. The matter proceeded to trial, whereat, both parties called witnesses who testified on their behalf, documents also were admitted in evidence.
