IBRAHIM SHATA BDLIYA, J.C.A (Delivering the Leading Judgment): This is an appeal against the judgment of the Gombe State High Court of Justice, Appellate Session, (hereinafter referred to as the lower Court) delivered on the 11th of March, 2005 which emanated from the judgment of the Kaltungo Upper Area Court (hereinafter referred to as the trial Court) delivered on the 30th of July, 2003. The Background facts of this appeal are that the appellant (who was the plaintiff) sued the respondent (who was the defendant) before the trial Court of claiming a farmland which he allegedly inherited from his father. The trial court entered judgment in his favour. The respondent was not satisfied with that judgment, he therefore appealed to the lower court. After the hearing of the appeal, the lower Court allowed it, set it aside and entered same in favour of the respondent.
