RAPHAEL CHIKWE AGBO, JCA (Delivering the Leading Judgment): In Suit No. HOR/56/2012, Dame Joy Okeke obtained judgment against the Inspector-General of Police and same Police Affairs at the High Court of Imo State in the sum of ₦5 Million and ₦10,000.00 costs. The judgment debtors were unwilling to pay. The judgment creditor took out a garnishee proceeding in HOW/405/2013 against several banks including the appellant seeking to attach the judgment debtors funds domiciled in them. Upon the motion ex-parte filed by the judgment creditor, the High Court of Imo State made an order nisi against the appellant.
