ROWLAND JCA (Delivering the Lead Judgment): This is an appeal against the ruling of Obi, J. of the Calabar Judicial Division of the Cross River State High Court, delivered on the 20th day of March, 2000, in suitNo. C/MSC.126/99.

The respondent on the 12th day of July, 1999, sought for and obtained an ex parte order directing the appellant to “effect immediate payment of the sum of N1,210,000.00 (one million two hundred and ten thousand naira) only, from the appellant to the respondent, being compensation for 104 beneficiaries of Mobil Oil spillage from Bakassi Local Government Area of Cross River State of which 104 cheques have already been issued to the claimants by Mobil Nigeria Unlimited.” The enrolled order was duly served on the appellant. A As borne by the records, while still investigating and looking at the records, a writ of attachment was served on the appellant to attach its two bullion vans.
