MASSOUD ABDULRAHMAN OREDOLA, J.C.A.(Delivering the Leading Judgment): This is an appeal against the judgment of the Customary Court of Appeal of Abia State of Nigeria holden at Umuahia, (hereinafter referred to as the Lower Court) delivered on the 29th day of June, 2006 by Hon Justice E. U. Onuaha, JCCA, (who read the lead judgment), Hon. Justice A. Onwuchekwa (KSC), PJCCA and Hon. Justice S. M. Ururuka-Onyensoh, JCCA.
