MASSOUD ABDULRAHMAN OREDOLA, J.C.A.(Delivering the Leading Judgment): This is an appeal against the judgment of the Customary Court of Appeal of Abia State of Nigeria holden at Umuahia, (hereinafter referred to as the Lower Court) delivered on the 29th day of June, 2006 by Hon Justice E. U. Onuaha, JCCA, (who read the lead judgment), Hon. Justice A. Onwuchekwa (KSC), PJCCA and Hon. Justice S. M. Ururuka-Onyensoh, JCCA. The suit which led to this appeal was commenced by the plaintiff/appellant (hereinafter referred to as the appellant) and his hitherto co-plaintiffs, in a representative capacity against the defendants/respondents (hereinafter referred to as the respondents) also, in a representative capacity, at the Customary Court of Abia State of Nigeria, holden at Ugwunagbo, wherein the appellant sought for the following reliefs:
