(Delivering the Leading Judgment): By way of a Motion on Notice numbered NSHC/SD/143M/2023 filed on the 20th September, 2023, before the High Court of Niger State (the lower Court), brought pursuant to Section 6(6)(a) of the 1999 Constitution of the Federal Republic of Nigeria (as amended), Sections 66(F) and 72 of the Sheriffs and Civil Process Act, CAP S6, Laws of the Federation of Nigeria 2004, and under the inherent jurisdiction of the lower Court, the Respondent, as Applicant, sought reliefs against the Appellant, as Respondent, as follows:
