STEPHEN JONAH ADAH, JCA (DELIVERING THE LEADING JUDGMENT): This is an appeal against the judgment of the Uyo Division of the Akwa Ibom State High Court in Charge No. HU/28C/02 delivered on the 20th day of August, 2004 by A. B. USEN, J. The offence charged was for Armed Robbery contrary to Section 1(2), (9) of the Robbery and Firearms (Special Provisions) Decree No. 5 of 1984. The accused person at the trial court who is now the appellant was convicted for the offence of armed robbery and sentenced to death.

The appellant was dissatisfied with the judgment of the trial court so he now appealed to this court vide his notice of appeal filed sequel to the leave of court granted on 5th December, 2016. The notice of appeal was filed on 19th December, 2016.
