1. This appeal is against the ruling of the Governorship Election Tribunal sitting in Makurdi delivered on the 28th day of February, 2012 sticking out Petition No: GET/BN/02/2011. The facts leading up to this appeal as presented in the brief of the Appellants with some modifications are as follows:-

The Petitioners/Appellants had challenged the election and return of the 1st Respondent as the duly elected Governor of Benue State during the April 26, 2011 general election held in Nigeria including Benue State.

2. The petition had a chequered history. It was filed by the Appellants (as petitioners on the 17th day of May, 2011,) in challenge of the declaration by the Independent National Electoral Commission (3rd Respondent) on 27th April, 2011 of Gabriel Torwua Suswam (1st Respondent) as the duly elected Governor of Benue State.
