MIKA’ILU JCA (Delivering the Lead Judgment): By way of originatingsummons, an action was instituted against the appellants in the High Court of Anambra State, Ekwulobia in suit No.AG/l08/98, Chief Alaeke Alaebe and 5 Others v. Chief J. Okwu Ugwu and 7 Others . The claims of the respondents/plaintiffs were for the following:
A declaration that the decision of the Anambra State Boundary Committee to which the Anambra State Government gave approval whichwas communicatedto the plaintiffs in the letter A of the secretary to the State Government dated November 11, 1997 is null and void and of no effect whatsoever. An order settingaside the said decision of the Anambra State Boundary Committee and the approval thereon given by the Anambra State Government in the said letter dated November 11, 1997.
