ABBA BELLO MOHAMMED, JCA (DELIVERING THE LEADING JUDGMENT): This is an interlocutory appeal against the ruling of the Federal High Court of Nigeria, Abuja, delivered by Hon. Justice John Terhemba Tsoho, on the 1st of February, 2022. At the trial court, arguments were heard by both parties in respect of a no-case submission filed by the Appellant. In the ruling, the trial court had overruled the Appellant’s no-case submission and directed him to enter his defence. The ruling is at pages 198 – 207 of the Record of Appeal.

Dissatisfied with the ruling, the Appellant filed Notice of Appeal on 15th of February, 2022, which is contained at pages 211-213 of the Record of Appeal. The Record of Appeal was transmitted on the 22nd of March, 2022. The Appellant filed a Brief of Argument on the 14th of June, 2022 which was deemed properly filed on the 26th of June, 2024. The Respondent who was duly served with the Appellant’s Brief of Argument did not file any Brief of Argument.
