ABDULLAHI JCA (Delivering the Lead Judgment): This is an appealagainst the decision of Kwara State High Court of Justice sitting at Ilorin in suit No. KWS/259/92 delivered by Oluyemisi Ajayi (J) on 6th October, 2005 wherein the learned trial Judge set aside the respondent’s termination who was the plaintiff at the lower court, who instituted an action claiming the following reliefs in his writ of summons and amended statement of claim as follows:
“1. A declaration that the defendants’letter dated 6th October, 1992 which terminated his employment from the defendants’ service is irregular, illegal, unlawful, null, void and of no effect whatsoever and should be set aside.
An order compelling the defendants to withdraw the said letter dated 6th October, 1992.
