MANGAJI, JCA (Delivering the Lead Judgment): The appellant herein was arraigned before the High Court of Benue State charged with the offence of rape punishable under section 283 of the Penal Code of Northern Nigeria which is applicable to Benue State. After full trial in which both the prosecution and the defence called witnesses, the learned trial Judge reserved judgment. On 14/8/2000 judgment was delivered wherein the appellant was found guilty of the offence charged and accordingly convicted. The appellant was sentenced to three years in prison and a fine of ₦200.00 with a further order that the appellant shall serve a sentence of one month in prison in addition, in the event of his failure to pay the fine. Appellant is dissatisfied with the judgment. Accordingly he filed a notice of appeal containing three grounds primarily questioning the findings of the learned trial Judge as it affected the issue of alibi raised by the appellant as well as the vexed issue about corroboration…
