(Delivering the Leading Judgment) This is an appeal against the Ruling of the Federal High Court Abuja (Coram Adah J) wherein the learned trial Court refused the Appellant's application for -adjournment to call the rest of the Appellants' witnesses including a witness against whom a writ of subpoena ad testificandum was issued by the Honourable Court and directed a closure of the case of the Appellants.
The Appellants being dissatisfied with the conclusion of the learned trial Court filed a Notice of Appeal containing two grounds of appeal.
FACTS:
By a writ of summons dated 23/9/2005 the 3rd and 4th Respondents commenced this suit in the Federal High Court, Abuja against the 1st and 2nd Respondents as the only Defendants.
