(Delivering the Lead Ruling): This is an Application filed by way of a Motion on Notice on 11/1/2017 by the Appellant/Cross Respondent/Applicant and brought pursuant to Section 36 of the Constitution of the Federal Republic of Nigeria 1999 (as amended) and Order 6 Rules 4 and 15; Order 7 Rule 1 of the Court of Appeal Rules 2011 praying this Court for the following orders, to wit:

1. An order granting leave to the Appellant/Applicant to further amend the Amended Notice of Appeal filed on 9/5/2012 in terms of the proposed Further Amended Notice of Appeal attached as Exhibit A.

2. An order granting leave to the Appellant/Applicant to raise afresh issue of law that was not raised and argued before the Court below in terms of the new Ground 8 in the proposed Further Amended Notice of Appeal as in Exhibit A.
