HARUNA SIMON TSAMMANI, JCA (Delivering the Leading Judgment): This appeal is against the Judgment of the Oyo State High Court delivered by Hon. Justice B. O. Adeniji on the 3rd day of December, 2013 in Suit No. I/219/97.

The suit was instituted by the Respondent who was Plaintiff in the trial Court, by way of a Writ of Summons filed on the 13/3/97. This was followed by a Statement of Claim dated the 21/4/97 and filed on the 22/4/97. The Statement of Claim was amended twice with the suit being heard on the Further, Further Amended Statement of Claim dated and filed on the 12/01/2009. By paragraph 41 of the said Further, Further Amended Statement of Claim, the Plaintiff/Respondent sought for the following reliefs:

(a) Declaration that the purported suspension of the Plaintiff by the Defendant based on letter dated 13th day of December, 1995 was illegal, null and void as there was no Police Report that indicted the Plaintiff as claimed under reference.
