(DELIVERED BY EBIOWEI TOBI, JCA) This instant appeal is against the judgment of the High Court of Lagos State delivered on the 19/9/2011 by Honourable Justice Olateru-Olagbegi in Suit No. LD/2525/2003; Idera-Olu Trading Company Limited and Anor. v. United Bank for Africa Plc wherein the court dismissed the Respondents’ (Claimants in the lower court) case and granted the counterclaim of the Appellant (then Defendant at the lower court) to the extent of the sum of N4,849.10 as against the sum of N7,624,276.69 claimed as counter-claim.
The Defendant in the lower court (now appellant) being dissatisfied with the decision of the lower court has filed this appeal. The Appellant’s extant notice of appeal is the amended notice of appeal filed on the 28/1/2014. The simple facts of the case is that the 1st Respondent (1st Claimant at the lower court) is a customer of the Appellant (Defendant/counter-claimant at the lower court) at its Idumagbo branch.
