SAMUEL CHUKWUDUMEBI OSEJI, J.C.A.(Delivering the Leading Judgment): The Respondent herein had as claimant in the lower Court brought an action by a writ of summons dated and filed on the 8th day of September, 2009 against the defendants (now Appellants).
In paragraph 12 of the statement of claim filed on 12/10/2009 the Respondent claimed as follows:
12. WHEREFORE the plaintiff claim against the Defendants jointly and severally the following relief(s):-
(a) The sum of N20,000,000.00 (Twenty Million Naira) only being special and General Damages suffered by the plaintiff on account of the land transaction.
SPECIAL DAMAGES
1. N780,000.00 being the purchase price of the land - N780,000.00
2. Money spent on preparation of Deed of Conveyance - N35,000.00
3. Money spent on the surveying of the land - N40,000.00
4. Clearing and stumping/uprooting of trees on the land - N50,000.00
5. Expenses for leveling the land - N50,000.00
Total Special Damages - N955,000.00
