PEMU JCA (Delivering the Lead Judgment): This appeal emanated from the decision of O. H. Oshodi J. of the High Court of Lagos State in his two rulings of 25 September 2006, page 56 of the record, and that of 2 March 2007, pages 66 - 68 of the record of appeal.

With leave of this honourable court, the two appeals were permitted to be heard and argued together on the same record of appeal, and the same briefs of argument, vide order of court made on 28 January 2011. Apparently, the decision of 25 September 2006, is inherent ex facie in the proceedings of the court on that date, as a result of which a notice of A appeal was filed on 6 October 2006 encapsulating two (2) grounds of appeal, pages 57 - 58 of the record of appeal. The ruling of 2 March 2007 is at pages 63 - 65 of the record of appeal, with an amended notice of appeal filed on 12 July 2011, and which encapsulates an additional ground of appeal.
