JOSEPH TINE TUR, JCA (Delivering the Leading Judgment): This appeal has been brought against the judgment of Hon. Justice A.F.A. Ademola J., of the Federal High Court, Calabar, Cross River State delivered on 25-10-2010. His Lordship made series of awards/orders in favour of the Respondent Dr. Peter Gbolade Akintunde, a lecturer in the Department of Vocational and Special Education of the University of Calabar after the learned trial Judge found that the Respondent's suspension from his employment on two occasions namely 11-08-2005 and 13-08-2008 were contrary to Section 16(4) of the University of Calabar Act, Cap U5, Laws of the Federation of Nigeria, 2004. That the University and the Vice Chancellor had acted "unreasonably, arbitrarily and capriciously."
