ITA G. MBABA J.C.A. (Delivering the Leading Judgment): This is an interlocutory Appeal against the Ruling of the Federal High Court Ilorin, presided over by A. O Faji J, delivered on 27/10/2011. The learned trial Judge had refused the applications of the defendants (now appellants) to admit some documents as exhibits, tendered through the PW1, under cross examination. The 1st document, an agreement between Academic Staff Union of Universities (ASSU) and the Federal Government on funding of University Secondary Schools, was rejected because the document was not pleaded and that the same was not relevant, while the second (a letter written to the appellants by the National University Commission (NUC) on the status of the Universities Secondary Schools was rejected because it was made during the pendency of the case, and that the same was made by a party interested, which, according to the Court, was the National Universities Commission (NUC) from whom the pleaded correspondence (see pag…
