HAMMA AKAWU BARKA, JCA (Delivering the Leading Judgement): The instant appeal is against the judgment of the National Industrial Court sitting in Uyo, the Akwa Ibom State Capital in Suit No. NICN/CA//95/2014 between Camillus Domingo Udo and 32 ors. against The University of Uyo Teaching Hospital and one other, delivered on the 30th of January, 2018; wherein the judgment was entered for the plaintiffs in the following terms:
THE COURT HEREBY DECLARES that failure and/or refusal of the Defendants to comply with the Federal Government Circulars, particularly Re. No. HCSF/PSO/PARA/ 437/3402/T1/95 dated 24th December, 2008 titled “absorption of severed staff reinstated into the service by the steering committee on public Service Reforms” is contrary to the provisions and spirit of Public Service.
