JAMES GAMBO ABUNDAGA, JCA (Delivering the Leading Judgment): The high court of Kaduna state presided over by Hon. Justice N. U. Sadiq delivered judgment in Suit No. KDH/KAD/129/2021 on 16th June 2022.
The learned trial judge in his judgment non-suited the plaintiff after taking addresses from counsel to the parties.
The plaintiff is irked by this decision and decided to appeal same. He filed a notice of appeal on 14/7/2022 containing four (4) grounds of appeal.
In the appeal, he prayed for the following reliefs
“1. To allow the appeal.
2. To set aside the judgment of the Kaduna State High court of Justice, Kaduna presided over by Hon. Justice N. U. Sadiq delivered on 16th June, 2022.
3. An order of this Honourable court granting judgment in favour of the Appellant in accordance with the reliefs originally sought in the substantive suit before the lower court.
4. And for such further orders as the Appellate court may deem necessary to make in the circumstance of this appeal”.
