JUDGMENT
This appeal arises from the Ruling and Order of Jairus Ngaah, J delivered on 27th August 2021 in Nairobi (Milimani) High Court (Judicial Review Division) Case No. E091 of 2021. In this case, the appellant, Veronica Ngina Kanja, had applied for judicial review orders vide her Notice of Motion dated 16th July 2021 seeking –
a. an order of certiorari to remove to the High Court and quash the final Order No. 3 in the impugned decision of the Public Procurement Administrative Review Board (the 1st respondent herein) dated 29th June 2021 together with all consequential actions, including an order quashing the Communication on Award dated 5th July 2021 and any/all such letters issued following the orders of the 1st respondent;
b. an order of Mandamus compelling the Accounting Officer in the State Department for Livestock, Ministry of Agriculture, Livestock, Fisheries and Cooperatives (the 2nd respondent) to evaluate the appellant’s bid and award Tender No. MOALF & C/SDL/ONT/14/2020-202…
