RULING ON APPLICATION FOR SUMMARY JUDGMENT
At its previous sitting on this matter, and after listening to the submissions of lawyers in the matter, the court granted the plaintiff’s applicant leave to enter final judgment in terms of the reliefs endorsed on the writ of summons, and adjourned the matter to today for the reasons underlying the decision of the court. The application was grounded on Order 14 Rule 1 of the Rules of Court pursuant to a civil claim per a writ of summons that the applicant as plaintiff had filed against the defendant.
The facts of the case that I deem necessary to recite here briefly are that the plaintiff is a Co-operative Credit Union, whilst the defendant is the plaintiff’s accountant at all material times.
