MOHAMMED LAWAL GARBA, JCA (Delivering the Leading Judgment): The Appellant along with the Appellant in Appeal No. CA/L/348CA/17, was convicted by the Lagos state High Court in the judgement delivered on the 13th January, 2017 for the offences of conspiracy to commit forgery, forgery, altering false documents, conspiracy to obtain by false pretence and obtaining by false pretence, punishable under the Criminal Code Law of Lagos State and the Advance Fee Fraud and Other Related Offences Act, 2006.

The Appellant was the Chairman of Ontario Oil and Gas Ltd, the 4th Defendant to the charge, was said to have through the 4th Defendant and the Appellant in Appeal No CA/L/348CA/17; who was the 2nd Defendant, knowingly presented forged documents in respect of the quantity of Petroleum Motor spirit (PMS) discharged at the Depots of Integrated Oil and Gas Ltd and Obat Oil and Gas Ltd, for the purpose of claims for petroleum products subsidy from the Federal Government.
