OGUNBIYI JCA (Delivering the Lead Judgment): The appellant inthis appeal was the defendant in the High Court of Lagos State sitting at Ikeja while the respondent was the plaintiff, who sued the defendant for a declaration that the purported termination of his employment by the said defendant constituted a wrongful dismissal. He also prayed the court to order the defendant to pay the sum of N41,040.00 being the amount of scholarship awarded to the plaintiff’s daughter while in the employment of the defendant; a further order sought was to direct the defendant to allocate 14,500 tonnage of cement being the plaintiff ’s entitlement under the defendant’s staff cement allocation benefit scheme amongst others.
