OGBUAGU JCA (Delivering the Lead Judgment): This is an appeal by the plaintiff/appellant against the judgment/decision of the Benue State High Court sitting in Makurdi and delivered on 27th July, 2000 by Ogbole J. dismissing the case/suit of the appellant challenging the termination of his probationary/temporary appointment as a Magistrate II by the 1st respondent.

Dissatisfied with the said decision, the appellant, has appealed to this court.

The facts briefly stated, are that the appellant was offered a temporary appointment by the 1st respondent vide exhibit 1 which contained certain conditions. The appellant accepted the offer/appointment. In exhibit 14, he gave/signed an undertaking of honour to the effect to be of good behaviour. He also therein, undertook to abide by the rules of conduct relating to judicial officers in the service of the 1st respondent.
