PETER OLABISI IGE, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Federal Capital Territory High Court, Abuja in Suit No: FCT/HC/CV/1643/2014 contained in the decision of Hon. Justice U. P. KEKEMEKE delivered on 15th day of June, 2017.

The Respondent as the Plaintiff at the Lower Court had by her Writ of Summons issued out of the said Court on 28th May, 2015 claimed against the Defendant now Appellant the following reliefs:-

"(a) A DECLARATION that the Plaintiff is the bona-fide owner of and entitled to the possession (as the holder of the statutory right of occupancy) of the piece of land measuring approximately 1.23 hectares better known and described as Plot No.1216 located at Cadastral Zone A7 Wuse District which falls on sheet 332/1002/NVV3 and covered by the Certificate of Occupancy No. FCT/ABU/MISC/12187 dated 19th day of October, 1994 issued under the hand of the Honourable Minister of the Federal Capital Territory and duly registered as …
