The Plaintiff instituted this action on the 20th July, 2016, against the Defendants for the following reliefs:
(a). A declaration that Defendants excessive noise from their worship in an exclusively residential area constitutes an interference with Plaintiff’s right to privacy of home.
(b). An order to compel Defendants to remove the Church structure.
(c). Any other order (s) as this Honourable Court may deem just Applicant.
The Defendants entered appearance and filed their Statement of Defence on 24th August, 2016. At the application for directions stage, this Court urged on the parties to attempt settlement in respect of the case. This subsequently led to the parties settling the matter and filling the terms of settlement on 17th May, 2017.
