FREDERICK OZIAKPONO OHO, J.C.A. (Delivering the Leading Judgment): This Appeal is against the Judgment of the Federal High Court of Nigeria sitting at Sokoto in Suit Number FHC/S/CS/26/2010 delivered on the 23rd of December, 2013 in which the Court dismissed the Suit of the Appellant as Claimant against the Respondents as Defendants. See pages 612 - 637 of the records of Appeal. The Appellant as Claimant on the 24-8-2010 as a Retired civil servant of the Federal Ministry of Education, Sokoto filed an action against the Respondents as Defendants at the Federal High Court, Sokoto vide a writ of summons, where upon the Appellant claimed sundry reliefs. The suit arose when the Appellant applied to the 2nd Respondent for the purchase of the property in dispute, more appropriately described as Number 61, Ali Akilu Road, Sokoto, known as SSWB/C1.6104, 0040 FMHSE 26, some five years after his retirement from the civil service and had ceased to be a civil servant.
