MOORE A. A. ADUMEIN, J.C.A. (Delivering the Leading Judgment): The appellants were the plaintiffs in suit No.HOS/61/2004 commenced in the High Court of Osun State, Osogbo Judicial Division. The appellants claimed against the respondents in the court below as follows:

"(1) Declaration that the Plaintiffs as successors of the Estate of late Seidu Jabita Williams are owners and entitled to statutory right of occupancy of the land, houses and premises situate, lying and being at No. 2, Catholic Mission Road, Osogbo, Osun State.

"(2) A declaration that the purported sale or disposition of the land, houses and premises by one Chief Adesina Musiliudeen and others on behalf of the accredited representatives of Seidu Jabita Williams on 7th December, 1993 to Alhaji Alabi Idris Adebayo, be set aside and declared null and void and of no effect.
