MUHAMMAD IBRAHIM SIRAJO, J.C.A. (Delivering the Leading Judgment): Before the High Court of Rivers State, Port Harcourt Judicial Division (the lower Court), the Appellants, who are mother and daughter respectively, instituted an action, as Claimants, against the Respondents, as Defendants, in Suit No. PHC/3465/2017. While the 1st Appellant is the Widow of late E.W.J. Woherem, who died intestate in Port Harcourt on 15th day of August, 2013, the 2nd Appellant and the 1st and 2nd Respondents are among the twelve (12) surviving children of the late E.W.J. Woherem, though the 1st and 2nd Respondents are of different mothers from the 2nd Appellant. Following a dispute over the properties left behind by the late E.W.).
