NWEZE JCA (Delivering the Lead Judgment): The appellants were charged before the High Court of Kwara State, holden at Ilorin with the offence of armed robbery contrary to section 1(2)(a) of the Robbery and Firearms (Special Provisions) Act, Cap. 398, Laws of the Federation of Nigeria, 1990 [now, section 1(2)(a) of the Robbery and Firearms (Special Provisions) Act, Cap. R11, Laws of the Federation of Nigeria, 2004. In proof of its case, the respondent called four witnesses and tendered eight exhibits.
