JAMILU YAMMAMA TUKUR, J.S.C. (Delivering the Leading Judgment): The appeal is against the judgment of the Court of Appeal, Gombe Division, delivered on 25th March 2022 in Appeal No. CA/G/98C/2021, wherein the lower Court dismissed the appeal filed by the Appellant herein against the decision of the trial High Court of Gombe State, which found the Appellant guilty for the offence of rape punishable under Section 283 of the Penal Code and sentenced him to 14 years imprisonment.

The Appellant’s Notice of Appeal was filed on 22nd April 2022 and is at pages 125 - 128 of the record of appeal.

The Appellant’s brief of argument was filed on 9/2/2023 and deemed properly filed on 15/1/2026 and in it were nominated two issues for determination viz:
