The Application was contested by the 1st Respondent. The Lower Court delivered its ruling on the 21st day of December, 2022, the application was refused and same was dismissed accordingly. The ruling is contained at pages 353 to 358 of the Record of Appeal.
The Appellant being dissatisfied with the said ruling appealed to this court vide Notice of Appeal dated 2nd day of January, 2023 and filed on the 3rd day of January, 2023, containing three counts.
