JAMES SHEHU ABIRIYI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment delivered on 24th June, 2015 in the High Court of Gombe State sitting in Gombe. The Appellant was the plaintiff in the lower Court. The Respondents were the Defendants.
The claim of the Appellant at the lower Court was for the following:
(i) A declaration that by our Shongom custom, he is now the legitimate owner and dully qualified for a declaration of title to all that piece or parcel of land located at Pokwaka near Lalaipido Maternity clinic in Shongom local government of Gombe State.
(ii) A declaration that the various unlawful accts (sic) of the Defendants of entering unto the said property and partitioning, selling and buying of plots thereon without the Plaintiffs knowledge or consent amounts to trespass.
