ADEREMI JCA (Delivering the Lead Judgment): In the application dated 1st of June, 2005 but filed by 1st defendant/appellant/applicant has prayed for the following: “(1) an order grantingthe defendant/applicant an extension of time within which to apply for leave to appeal against the decision of the High Court of Justice, Port Harcourt, Rivers State contained in the ruling dated 2nd December, 2004 in suit No. PHC/1973/99. an order granting the 1st defendant/appellant/applicant leave to appeal against the decision dated 2nd December, 2004 in suit No. PHC/1973/ 99 and an order granting the 1st defendant/appellant/applicant an extension of time within which to file his notice of appeal with respect to the decision.”
