(DELIVERING THE LEADING JUDGMENT): This is an appeal against the judgment of the Court of Appeal, Yola Judicial Division (hereinafter "lower Court”), delivered on 21st September, 2021, In Appeal No: CA/YL/111C/2020, which affirmed the conviction and sentence entered by the High Court of Justice, Taraba State, Jalingo Judicial Division (hereinafter "trial Court") against the Appellant.
On 19th July, 2017, the Appellant, Ahmadu Alh. Yunusa was arraigned, alongside three other accused persons, namely: Lawal Alh. Yunusa (1st accused person), Gambo Ango (3rd accused person), and Alh. Baido Ango (4th accused person), at the High Court of Justice, Taraba State, Jalingo Judici.al Division.
