OLABODE ABIMBOLA ADEGBEHINGBE, J.C.A. (Delivering the Lead Judgment): According to the Respondents, the land in dispute was founded by a person known as Kpana Halladi, who first settled thereon. It was Kpana Halladi who later made a gift of the land in dispute to one Kpana Nyama, his brother. The story told by the Respondents is that, due to the childlessness of one Wonodibawulan, Kpana Nyama eventually gave the land in dispute to Madam Dingno Anungno on the conditions that she would marry Wonodibawulan, bear children for him and that the land in dispute would be left for the children Madam Dingno Anungno would have for Wonodibawulan, as their property. As it turned out, Madam Dingno Anungno had only Victor Zane, a male child for her husband, who she compliantly married. The Respondents are children (from two wives) born to their father, Victor Zane.
