OBADINA, JCA (Delivering the Lead Judgment): In paragraph 18 of their second further amended statement of claim, the appellants, as plaintiffs, claimed as follows:
“(a) A declaration that the property in dispute covered by the Statutory Right of Occupancy numbered NE/818 not having been alienated by way of sale or assignment by theholder during his life-time, automatically devolved on his heirs at his death. A declaration that the third defendant is not the registered holder or assignee of the property in dispute covered by Statutory
