GALADIMA, JCA (Delivering the Lead Judgment): This is an interlocutory appeal against the decision of Honourable Justice C. O. Segun (as he then was) of the High Court of Lagos State granting an order of interlocutory injunction on 7/2/96 restraining the appellant, its agents or privies from giving effect to the letter dated 3/11//95 terminating the respondent’s employment with the appellant. The appellant was also directed to refrain from stopping or in any way tampering with the respondent’s salary, emoluments and fringe benefits as well as other facilities and amenities which the respondent enjoyed before her termination pending the determination of the substantive suit.

The respondent, as plaintiff, had taken out a writ of summons, claiming against the appellant, as defendant, for a declaration, inter alia, that her termination was null and void and of no effect and that she is still in the employment of the appellant and so, she is entitled to all her benefits.
