AN ACT to provide for the grant and protection of plant breeder rights and for related matters.

Application and conditions of variety

1. Scope of application

The provisions of this Act apply to all plant genera and plant species.

2. Meaning of variety

Variety means a plant grouping within a single botanical taxon of the lowest known rank which grouping, irrespective of whether the conditions for the grant of a plant breeder right are fully met, can be

(a)defined by the expression of the characteristics resulting from a given genotype or combination of genotypes;

(b)distinguished from any other plant grouping by the expression of at least one of the characteristics that result from a given genotype or combination of genotypes; and
