IN exercise of the power conferred on the Attorney-General and Minister responsible for Justice by section 62 of the Plant Variety Protection Act, 2020 (Act 1050), these Regulations are made this 3rd day of October, 2022.

Preliminary Provisions

1. Purpose of Regulations

The purpose of these Regulations is to provide for

(a)the procedure for

(i)filing applications made under the Act and these Regulations;

(ii)examination of applications made under the Act;

(iii)objections and oppositions to applications made under the Act and these Regulations;

(iv)cancellation of plant breeder rights; and

(v)cancellation of variety denominations;

(b)the restrictions of plant breeder rights;

(c)the administration of the register established under section 40 of the Act;

(d)publication requirements;
